Who’s Eligible

  • You are a Settlement Class Member if you are an individual residing in the United States whose Private Information may have been accessed and/or acquired by an unauthorized party as a result of the Data Incident disclosed by Defendant in April 2024.
  • This includes if you were previously notified by Consulting Radiologists, Ltd. about the Data Incident.
  • Excluded are: (1) the Judge presiding over this Litigation and their direct family; (2) the Defendant and its current or former officers and directors; and (3) those who validly exclude themselves.

What You Need to Do to Get Paid

You may submit a Claim Form online at the Settlement Website or by mail. To file online: Visit www.CRDataSettlement.com. Complete the online Claim Form with your personal information and Claim ID (if available). Select your preferred benefit (Cash Payment, Credit Monitoring, or Documented Losses). If claiming losses, upload supporting documentation. Submit the form by the deadline of March 2, 2026.

To receive reimbursement for Documented Monetary Losses, you must submit supporting documentation (e.g., receipts, bank statements) demonstrating that the loss is actual, documented, and fairly traceable to the Data Incident. Self-prepared documents alone are insufficient.

Settlement Class Members may claim one of the following benefits:

1. Cash Payment:

  • Group 1 (SSN accessible): Up to $125.
  • Group 2 (SSN not accessible): Up to $50.

2. Reimbursement of Documented Monetary Losses:

  • Up to $5,000 for out-of-pocket expenses fairly traceable to the Data Incident (e.g., bank fees, credit monitoring costs, losses from identity theft).

3. Credit Monitoring Services:

  • 2 years of CyEx’s single-bureau monitoring product, Identity Defense Complete (includes $1 million identity theft insurance).

All cash payments are subject to pro rata reduction if the total claims exceed the available settlement fund.

The Settlement provides for relief on a claims-made basis, subject to an aggregate cap of $2,200,000. Benefits include reimbursement of Documented Monetary Losses up to $5,000, Credit Monitoring Services for two years, or a Cash Payment of up to $125 (Group 1) or $50 (Group 2).
To qualify for credit monitoring or a cash benefit, you must submit a Claim Form online at www.CRDataSettlement.com or by mail to the Settlement Administrator. All forms must be received or postmarked no later than March 2, 2026.
The Final Approval Hearing is scheduled for February 25, 2026. If the Court approves the Settlement, payments will be sent after all appeals and reviews are completed.
