Eligible States
To get paid from the Bayer settlement:
Visit www.antifungalspraysettlement.com and submit your claim form online by 11:59 p.m. Hawaii-Aleutian Standard Time on March 11, 2026.
Mail your completed claim form postmarked by March 11, 2026 to: Antifungal Spray Settlement Administrator, c/o Rust Consulting, Inc. – 9111, PO Box 2661, Faribault, MN 55021-9661.
You have two claim options: submit a Proof of Purchase Claim with documentation of your purchase, or a No Proof of Purchase Claim by attesting under penalty of perjury (maximum 3 units per household). You cannot submit both types. Only one claim form per household is allowed.
You may submit Proof of Purchase showing the purchase date, specific product, and price. Alternatively, you can claim up to 3 products without proof by attesting under penalty of perjury that you purchased them during the settlement period.
Bayer settlement payments vary based on your claim type. If you submit a proof of purchase, you receive the actual purchase price (excluding taxes).
Without proof of purchase, you receive $7 per product, up to 3 units per household. Payments are subject to pro rata adjustment based on claim volume. If you received compensation through Bayer’s Recall Program, your settlement payment will be reduced by that amount.
This settlement resolves a class action lawsuit against Bayer and related defendants alleging they violated state laws and consumer protection statutes regarding the manufacturing, labeling, sale, and marketing of certain antifungal spray products. The lawsuit alleged that certain Bayer Products sold in the United States were contaminated with benzene, which was not disclosed. The case was filed in the United States District Court for the District of New Jersey as Huertas et al. v. Aeropres Corp., et al., Case No. 2:21-cv-20021.
The contaminated products were subject to Bayer’s October 2021 recall and included various Lotrimin and Tinactin spray products with specific lot numbers distributed between September 2018 and September 2021. Defendants have denied all allegations and the court did not rule in favor of either party. The parties agreed to the settlement to avoid the expense and risks of continued litigation and to provide benefits to affected consumers.
