Who’s Eligible

  • All persons and entities, and their heirs, successors, and assignees, who owned or had an ownership interest in, or a valid lien on real property that Defendant Multnomah County obtained through a foreclosure action to satisfy unpaid real estate taxes or other County or local government taxes and fees and associated fees and penalties.
  • The County must have sold the property for an amount in excess of the unpaid taxes, fees, and other costs associated with that property.
  • The statutory redemption period for the property must have expired during the Class Period, which is between October 12, 2017, and June 25, 2025.

What You Need to Do to Get Paid

To qualify for a Settlement Payment, you must complete and submit a Claim Form. You can file your Claim online at the official settlement website or send it by U.S. Mail to the Settlement Administrator. The deadline to submit a Claim Form is January 12, 2026.

Documentation may be required to verify the claim, especially for heirs, successors, or lienholders. Supporting documents might include deeds, mortgages, property tax statements, wills, obituaries, probate documents, death certificates, or birth certificates.

Settlement Payout

Estimated Payout Per Person

Each Class Member who submits a valid Claim will receive a Settlement payment from the Settlement Fund based on the Class Member’s pro rata share of the Settlement Fund. This amount is calculated after deducting attorneys’ fees, expenses, and service awards. If more than one valid Claim is made for Surplus Proceeds from a property, the total amount available to pay claims connected with that property will be the share of the proceeds associated with that property.

Background of the Lawsuit

The lawsuit alleges that Oregon Counties, including Multnomah County, violated Plaintiffs’ rights by failing to give Plaintiffs the proceeds from the sale of tax-foreclosed properties formerly owned by Plaintiffs that exceeded the unpaid taxes, fees, and other costs. Multnomah County denies doing anything wrong but has agreed to settle to avoid the cost and uncertainty of litigation.

Settlement Payments to Class Members will be made only after the Court grants final approval to the Settlement and after any appeals are resolved. If there are appeals, resolving them can take time.
