What You Need to Do to Get Paid
To get paid from the Disability Rights Wisconsin settlement:

Important
You must submit a claim form to receive any settlement benefits, including credit monitoring, reimbursement for time spent, or reimbursement for documented expenses. Without a submitted claim, you will receive no payments.
Attestation losses (up to $85) do not require documentation. Extraordinary out-of-pocket expenses (up to $2,000) must be documented with proof of the expense and your payment.
Settlement Payout
Disability Rights Wisconsin settlement payments include up to $85 for time spent addressing issues from the data breach (capped at 4 hours at $21.25 per hour) and up to $2,000 in reimbursement for documented out-of-pocket expenses such as fraud losses, professional fees, credit monitoring costs, and related expenses. Settlement class members are also eligible for two years of credit monitoring with at least $1 million in identity theft protection at no cost.

Background of the Lawsuit
In October 2023, a cybersecurity attack targeted Disability Rights Wisconsin’s information systems, potentially exposing the private and personal information of approximately 19,150 individuals. The breach was discovered and disclosed on or around June 21, 2024. Exposed information included names, treatment information, medical diagnoses, Social Security numbers, health insurance identification numbers, financial account information, dates of birth, and other personally identifiable or protected health information.
Class representatives William Geiger and Denise Gallagher filed lawsuits in Dane County Circuit Court alleging negligence, negligence per se, breach of implied contract, unjust enrichment, invasion of privacy, and seeking declaratory judgment under Wisconsin Statute § 806.04. The complaints were consolidated and interim class counsel appointed on September 9, 2024.
Disability Rights Wisconsin disputed the allegations. Rather than proceed to trial, the parties agreed to settle the case. The settlement provides reimbursement for time spent addressing the breach and documented out-of-pocket expenses, plus two years of free credit monitoring with identity theft protection. The Court authorized notice to the class on December 17, 2025, and is scheduled to consider final approval on April 30, 2026.
