What You Need to Do to Get Paid

To get paid from the Bayhealth Medical Center settlement:

Claim Online

  2. Click ‘Submit Claim’ to access the online claim form.
  3. Complete the claim form by selecting one or more benefits: pro rata cash payment (no documentation needed), out-of-pocket loss reimbursement (requires receipts/documentation), or medical monitoring enrollment.
  4. Submit your claim online by April 20, 2026.

  2. Complete the form and gather any required documentation (receipts for out-of-pocket losses).
  3. Mail the completed form and documentation to Kroll Settlement Administration LLC.

To receive an electronic or ACH payment, you must file your claim online via the settlement website.

Pro rata cash payments require no documentation. Out-of-pocket loss reimbursements (up to $5,000) require supporting documentation such as receipts or proof of costs incurred after July 31, 2024. Medical monitoring requires submission of an approved claim form.

Estimated Payout Per Person

Bayhealth settlement payments are estimated at $60 per person for a pro rata cash payment, though amounts may be adjusted based on the number of claims filed. Settlement class members may also claim up to $5,000 for out-of-pocket losses with documentation. Additionally, all class members can enroll in two years of free credit monitoring and identity theft insurance. Payments will be made by electronic transfer or check after court approval and appeals are resolved.

Background of the Lawsuit

In July 2024, Bayhealth Medical Center discovered a data incident that potentially compromised the personal information of individuals. Class representatives filed a lawsuit in the Delaware Superior Court alleging negligence, negligence per se, breach of implied contract, invasion of privacy, unjust enrichment, and breach of fiduciary duty. The case is titled Dunlop, et al. v. Bayhealth Medical Center, Inc., Case No. N25C-10-167.

Bayhealth denies any wrongdoing. Rather than proceed to trial, both parties agreed to a settlement that provides $2.5 million to compensate affected individuals through cash payments, out-of-pocket loss reimbursements, and free credit monitoring services. The settlement avoids the cost and uncertainty of litigation while delivering benefits to class members.

Yes. You must mail a Request for Exclusion to Kroll Settlement Administration postmarked by March 23, 2026. If you opt out, you cannot receive settlement benefits but you keep the right to sue Bayhealth separately.
After the June 5, 2026 Final Approval Hearing, the court must approve the settlement and any appeals must be resolved. Once that occurs and claim forms are processed, payments will be distributed. Electronic payments go to those who filed online.
